Customer Consent, Service Authorization & Liability Acknowledgment

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE AUTHORIZING SERVICE.

I, the undersigned customer (or authorized representative), hereby authorize OKC Mobile Brakes (“Company”) to perform the brake and/or rotor services described in the written estimate provided to me on this date at the location specified. By requesting, scheduling, approving, or authorizing services from OKC Mobile Brakes, I acknowledge and agree to the following terms and conditions.

1. Authorization of Services, Scope of Work & Estimate

I have reviewed the written estimate and authorize OKC Mobile Brakes to perform the automotive brake-related services specifically described in my estimate, work order, invoice, service request, or other written or electronic authorization, and to use the parts and materials described.

I understand that OKC Mobile Brakes is being authorized to perform the specific services I have requested or approved and is not being engaged to inspect, diagnose, repair, or guarantee every component or system of my vehicle unless a separate service has specifically been requested and authorized.

If additional work, parts, or repairs beyond the original estimate are found to be necessary for safe operation or proper completion of the authorized work, OKC Mobile Brakes will contact me for approval before proceeding, except in cases of immediate safety risk where delay would create a hazard, or where reasonably necessary to prevent additional damage, to the extent permitted by applicable law. Any additional work will be documented and charged at the Company's then-current rates.

2. Workmanship & Company Responsibility

OKC Mobile Brakes is responsible for the quality of its workmanship. The Company warrants that the services will be performed in a professional and workmanlike manner consistent with industry standards for mobile brake and rotor service.

This responsibility includes:

  • proper installation and torque of components;
  • correct selection and fitment of parts supplied by the Company; and
  • reasonable care in the handling of the vehicle and its systems during the service.

The Company remains liable for defects in its workmanship and for any damage to the vehicle directly caused by the Company's negligence in performing the authorized services.

If I believe that an issue exists as a direct result of OKC Mobile Brakes' workmanship, I agree to notify OKC Mobile Brakes as soon as reasonably possible and provide the Company a reasonable opportunity to inspect and, where appropriate, correct the workmanship issue. I understand that a subsequent failure, noise, vibration, warning light, or other vehicle problem does not automatically establish that the condition was caused by OKC Mobile Brakes' workmanship.

3. Scope of Responsibility

OKC Mobile Brakes' responsibility is limited to the workmanship and services actually performed by OKC Mobile Brakes.

OKC Mobile Brakes does not assume responsibility for the overall mechanical condition, safety, reliability, performance, or roadworthiness of the vehicle merely because brake services have been performed.

I understand that a vehicle contains numerous interconnected mechanical, electrical, hydraulic, electronic, suspension, steering, drivetrain, safety, and structural systems that may be unrelated to the brake service being performed.

Unless specifically included in the authorized service, OKC Mobile Brakes has no responsibility for diagnosing, repairing, monitoring, or guaranteeing those unrelated systems or components.

4. Pre-Existing Conditions and Unrelated Problems

I understand that my vehicle may have pre-existing conditions, defects, damage, wear, deterioration, modifications, improper prior repairs, corrosion, contamination, or other problems that existed before OKC Mobile Brakes performed any service.

The Company is not responsible for pre-existing conditions, hidden damage, or mechanical problems that were not caused by the Company's work and that could not reasonably have been discovered during the normal course of the authorized brake/rotor service. OKC Mobile Brakes shall not be responsible for problems, failures, damage, or expenses resulting from:

  • pre-existing conditions;
  • normal wear and tear;
  • corrosion or rust;
  • seized, broken, damaged, or deteriorated components;
  • improper prior repairs or installation;
  • modifications or alterations made by the vehicle owner or another person;
  • aftermarket or non-original equipment;
  • hidden or latent defects;
  • conditions that could not reasonably be discovered during the authorized service;
  • components unrelated to the work performed;
  • failure of another vehicle system;
  • electrical or electronic failures unrelated to the authorized work;
  • suspension, steering, wheel, tire, drivetrain, transmission, engine, cooling, electrical, computer, body, or structural problems not included in the authorized service;
  • damage caused by an accident, collision, road hazard, misuse, abuse, neglect, or improper operation;
  • the customer's failure to follow post-service instructions, improper vehicle operation after service, or subsequent modifications or repairs performed by others;
  • failure to follow maintenance or safety recommendations; or
  • any condition occurring independently of OKC Mobile Brakes' workmanship.

5. Brake System and Related Components

I understand that braking performance can be affected by numerous components and conditions beyond the particular parts being replaced or serviced.

These may include, without limitation:

  • brake calipers;
  • caliper slides and hardware;
  • brake hoses and lines;
  • master cylinder;
  • brake booster;
  • ABS components and sensors;
  • electronic brake-control systems;
  • wheel bearings;
  • suspension components;
  • tires and wheels;
  • parking-brake components;
  • brake fluid;
  • hydraulic components;
  • wheel hubs;
  • steering components; and
  • other vehicle systems.

Unless specifically inspected and included in the authorized service, OKC Mobile Brakes does not represent or warrant that these components are in safe, serviceable, or roadworthy condition.

6. Parts — No Customer-Supplied Parts

OKC Mobile Brakes does not use, install, or service customer-supplied parts, materials, hardware, or components under any circumstance. All parts installed are supplied by OKC Mobile Brakes.

Unless otherwise noted in writing, parts installed will be new or remanufactured parts of a quality suitable for the application. The Company will identify the brand and type of major components upon request.

Because all parts are supplied by the Company, OKC Mobile Brakes is responsible for the correct selection and fitment of those parts. The Company is not responsible for defects caused solely by a manufacturer's defect in a part, to the extent permitted by law, but will assist with any applicable part warranty.

7. Vehicle Condition, Location and Access

The Customer represents that the vehicle is legally and safely available for the requested service and that OKC Mobile Brakes has been given reasonable access to the vehicle and the components requiring service.

I understand that mobile service is performed at a location of my choosing (driveway, parking lot, workplace, roadside, or other location) that may not provide the same conditions as a traditional repair facility. I am responsible for providing a reasonably safe, level, and accessible work area, for securing any necessary permission from property owners or managers, and for ensuring that the service location provides reasonably safe and lawful access to the vehicle.

Weather, traffic, lighting, and site conditions may affect the ability to complete the work. OKC Mobile Brakes may reschedule, refuse, or discontinue service when, in its reasonable judgment, the location, conditions, or condition of the vehicle present an unreasonable safety risk.

I have disclosed any known issues with the braking system, ABS, electronic parking brake, or related components.

8. Additional Damage Discovered During Service

Automotive components may be rusted, seized, brittle, damaged, deteriorated, or otherwise difficult to remove.

During service, it may become necessary to work with components that are already damaged, corroded, seized, or near the end of their service life.

I understand that attempting to remove or service such components may reveal or result in additional problems that were not reasonably apparent before service began.

Where reasonably practical, OKC Mobile Brakes will notify the Customer of significant additional work or conditions discovered during service before proceeding with work outside the originally authorized scope.

9. Safety and Roadworthiness

I understand that OKC Mobile Brakes cannot guarantee that my vehicle is safe or roadworthy solely because brake service has been performed.

Unless specifically stated in writing, the completion of brake service does not constitute a complete vehicle safety inspection, pre-purchase inspection, state inspection, or certification that the vehicle is suitable for operation.

If OKC Mobile Brakes identifies a condition that it reasonably believes may make continued operation of the vehicle unsafe, the Customer may be advised not to operate the vehicle until the condition is corrected.

The Customer is ultimately responsible for deciding whether and when to operate the vehicle, subject to applicable law. After service, I am responsible for following any break-in or inspection recommendations provided by the Company.

10. Test Drive and Vehicle Operation

When reasonably necessary to verify workmanship or diagnose a brake-related concern, I authorize appropriately qualified personnel of OKC Mobile Brakes to operate the vehicle for a reasonable test drive or functional test.

I understand that a test drive may involve normal vehicle operation and that existing mechanical or safety problems unrelated to the authorized work may become apparent during operation.

Nothing in this section releases OKC Mobile Brakes from responsibility for damage caused by its own negligent or unlawful conduct to the extent such responsibility cannot legally be waived.

11. Limitation of Liability

To the maximum extent permitted by applicable law, OKC Mobile Brakes shall be responsible only for damages directly caused by negligent or defective workmanship attributable to OKC Mobile Brakes.

To the maximum extent permitted by law, OKC Mobile Brakes shall not be responsible for losses, damages, expenses, or claims arising from conditions or causes outside the workmanship actually performed by OKC Mobile Brakes, including pre-existing conditions, unrelated mechanical failures, normal wear and tear, misuse, abuse, neglect, improper maintenance, accidents, modifications, or the acts or omissions of third parties.

The Company's total liability for any claim arising from the services (other than claims for personal injury caused by the Company's negligence) shall not exceed the total amount paid by the customer for the specific services giving rise to the claim.

Nothing in this Agreement is intended to waive, release, or limit any right, remedy, warranty, liability, or obligation that cannot legally be waived, released, or limited under applicable law, including the Company's liability for its own workmanship or for personal injury caused by its negligence.

12. Consequential or Incidental Damages

To the maximum extent permitted by applicable law, OKC Mobile Brakes shall not be responsible for indirect, incidental, special, consequential, or economic losses arising from conditions outside the authorized workmanship, including but not limited to:

  • loss of use of the vehicle;
  • lost wages or income;
  • missed appointments;
  • missed work;
  • transportation expenses;
  • rental vehicle expenses beyond any amount expressly agreed in writing;
  • towing expenses after the vehicle has left the service location;
  • loss of business;
  • loss of profits;
  • business interruption; or
  • inconvenience.

This limitation does not apply to liability that cannot legally be excluded or limited, or to damages caused by the Company's failure to perform the work in a workmanlike manner.

13. Customer's Duty to Provide Accurate Information

I agree to provide OKC Mobile Brakes with accurate information regarding the vehicle, its history, known problems, modifications, previous repairs, symptoms, and circumstances relevant to the requested service.

I understand that failure to disclose known problems or relevant information may affect the ability to diagnose the vehicle accurately and may contribute to an improper diagnosis or subsequent failure.

14. No Guarantee of Unrelated Vehicle Condition

I understand and acknowledge that the completion of a particular repair does not constitute a representation or guarantee that the vehicle is free from other defects or that no additional repairs will subsequently be necessary.

Automobiles are complex mechanical systems, and unrelated problems may occur before, during, or after brake service.

15. Payment

Payment is due upon completion of the authorized services unless other arrangements have been made in writing. The Company accepts the payment methods listed on the invoice.

16. Governing Law

This authorization is governed by the laws of the State of Oklahoma. Any disputes shall be resolved in the courts of Oklahoma County, Oklahoma, unless otherwise required by law.

17. Customer Acknowledgment

By checking the acknowledgment box and submitting this authorization, I confirm that:

  • I have read this entire Consent, Service Authorization & Liability Acknowledgment.
  • I understand the scope of the services I am authorizing.
  • I understand that OKC Mobile Brakes does not use customer-supplied parts under any circumstance.
  • I understand that OKC Mobile Brakes is responsible for the quality of its workmanship as required by applicable law, and remains liable for defects in its workmanship and for damage directly caused by its negligence.
  • I understand that OKC Mobile Brakes is not responsible for unrelated vehicle problems, pre-existing conditions, normal wear and tear, or failures outside the workmanship actually performed, except to the extent otherwise required by law.
  • I understand that brake service does not constitute a complete inspection or guarantee of the vehicle's overall condition or roadworthiness.
  • I have had the opportunity to ask questions regarding the requested service, parts, and pricing before authorizing service.
  • I voluntarily authorize OKC Mobile Brakes to perform the services I have selected.
  • I agree to the terms of this Consent, Service Authorization & Liability Acknowledgment to the maximum extent permitted by applicable law.

Required customer acknowledgment

I HAVE READ, UNDERSTAND, AND AGREE TO THE OKC MOBILE BRAKES CUSTOMER CONSENT, SERVICE AUTHORIZATION & LIABILITY ACKNOWLEDGMENT. I AUTHORIZE THE SERVICES I HAVE SELECTED, I UNDERSTAND THAT OKC MOBILE BRAKES DOES NOT USE CUSTOMER-SUPPLIED PARTS UNDER ANY CIRCUMSTANCE, AND I UNDERSTAND THAT OKC MOBILE BRAKES' RESPONSIBILITY IS GENERALLY LIMITED TO ITS OWN AUTHORIZED WORKMANSHIP, SUBJECT TO APPLICABLE LAW.
